Privacy is important to Physicians Insurance A Mutual Company, its subsidiaries, and Physicians Insurance Risk Retention Group, Inc. (collectively, “Physicians Insurance”, “we”, “our”, and “us”). This online privacy policy (“Privacy Policy”) explains our data collection and use practices, and applies to any websites that we own and control, such as the www.phyins.com website (the “Website”) and any related products and services, including any associated interactive features, widgets, plug-ins, applications, content, downloads, and other services we may offer to you that posts a link to this Privacy Policy (collectively, the “Services”), regardless of how you access or use them, whether via personal computer, browser, laptop, tablet, mobile phone, or other device (each a “Device”).
This Privacy Policy describes how Physicians Insurance collects, uses, shares, and processes personal and other information and data of users of our Services. COLLECTION OF YOUR PERSONAL INFORMATION
We collect information from you in several ways, including when you choose to share information with us by entering it through our Website and by using automated processes. We also collect information about your transactions with us, such as any information you submit to us through our Services.
Information You Provide.

Please note that we use a third-party payment processor and so we do not store information about your payment card when you submit an online payment. If a claim is reported to us, we may require you to provide additional information, such as information about your insurance policy, including the policy number, and information about the harm suffered and the circumstances, causes, reasons, and events that led to the claim.
Information About Third Parties.
By submitting Personal Information about any third party, you represent and warrant to Physicians Insurance that you have the consent of the third party to do so, and that the information you submit is factually accurate.
In addition to any information that you choose to submit to us via our Services, we and our third-party service providers may use a variety of technologies that automatically (or passively) store or collect certain information whenever you visit or interact with our Services (“Usage Information”). This Usage Information may be stored or accessed using a variety of technologies that may be downloaded to your Device whenever you visit or interact with our Website. Please note that Physicians Insurance cannot guarantee the security of any information you transmit to us.
USERS OUTSIDE OF THE UNITED STATES
If you are from a non-U.S. country, please be aware that the Personal Information you submit, including information provided through our Services, is being sent to a location in the United States. The data protection laws in the United States are likely different from those of the country in which you are located, and your Personal Information may be subject to access requests from governments, courts, or law enforcement in the United States according to laws of the United States. SOCIAL SECURITY PROTECTION POLICY STATEMENT
It is our policy to protect the confidentiality of Social Security numbers (SSNs) from misuse and improper disclosure by maintaining and enforcing physical, electronic, and procedural safeguards. - CREATING USER ACCOUNTS.
Some of the Services features may require an applicable User to register for an account through an online registration process. When you register for an account, you will select login credentials and you agree that you: (i) will not use a username (or e-mail address) used by someone else, that impersonates another person, belongs to another person, violates the intellectual property or other right of any person or entity or that is offensive; (ii) will provide true, accurate, current and complete registration information about yourself and your organization during any registration process and will update it as needed to keep it accurate; (iii) will immediately notify us of any unauthorized use of your account, password or username, or any other breach of security; and (iv) will not sell, transfer, or assign your account or any account rights. You may be able to submit online claims for insurance benefits under an existing Physicians Insurance Policy. If you submit an online claim, you agree that you will not submit any information that you know to be, or have reason to believe to be, false, fraudulent, deceptive, inaccurate, misleading, or infringing on any third party’s rights.
When submitting a claim online, you may be redirected to a third-party website. Physicians Insurance does not control any third-party website, and these Terms of Use do not apply to your use of any third-party website. Please be sure to read the terms of use of any third-party website you visit.
- ONLINE BILL PAY
To submit any online payments to our Services, you must be at least the applicable age of majority in your jurisdiction of residence. If you choose to make an online payment, you will be taken to our third-party payment processor’s website and you will be prompted to supply payment information. By submitting that information to our credit or debit card processor, you hereby agree that you authorize us and/or our processor to charge your card at our convenience, but within thirty (30) days of credit or debit card authorization. You hereby represent and warrant to us that you will not use any credit or debit card or other form of payment unless you have all necessary legal authorization to do so. You agree to pay all fees and charges incurred in connection with your payments (including any applicable taxes) at the rates in effect when the charges were incurred. If Physicians Insurance does not receive payment from your credit card issuer or its agent, you agree to pay all amounts due upon demand by Physicians Insurance or its agents.

Submitting Consumer Requests
You may submit a consumer request to us by email at talktous@phyins.com, or by phone at (800) 962-1399 (toll free) to make a consumer request. You may make up to two disclosure requests in any 12 month period.
Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.
Making a verifiable consumer request does not require you to create an account with us.
When you submit a verifiable consumer request, we will take steps to verify your request by email or telephone call. In some cases, we may request additional information in order to verify your request or where necessary to process your request. If we are unable to adequately verify a request, we will notify the requestor. Authorized agents will be required to provide proof of their authorization and we may also require that the relevant consumer directly verify their identity and the authority of the authorized agent.
We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.
Right to Know and Access Your Information

Authorized agents will be required to provide proof of their authorization to submit opt-out requests and we may also require that the relevant consumer directly verify their identity and the authority of the authorized agent in limited circumstances.

You may use an authorized agent to submit a consumer request. To use an authorized agent, you will need to (i) provide written instruction to your agent, and verify your identity to us, or (ii) provide a power of attorney pursuant to California Probate Code Sections 4000 to 4465.
