Privacy is important to Physicians Insurance A Mutual Company, its subsidiaries, and Physicians Insurance Risk Retention Group, Inc. (collectively, “Physicians Insurance”, ‎“we”, “our”, and “us”‎). This online privacy policy (“Privacy Policy”) explains our data collection and use practices, and applies to any websites that we own ‎and ‎control, such as ‎the www.phyins.com website (the “Website”) and any related products and services, including any ‎‎associated interactive features, widgets, ‎plug-ins, applications, content, downloads, and other ‎‎services we may offer to you that posts a ‎link to this Privacy Policy (collectively, the ‎‎‎“Services”), regardless of how you access or use ‎them, whether via personal computer, browser, ‎‎laptop, tablet, mobile phone, or other device ‎‎(each a “Device”).

  1. COLLECTION OF YOUR PERSONAL INFORMATION

We collect information from you in several ways, including when you choose to share ‎‎‎information with us by entering it through our Website and by using automated processes. ‎We ‎‎also collect information about your transactions with us, such as any information you ‎submit to ‎‎us through our Services. 

  1. Information You Provide.

We may ask you and you may choose to provide certain “Personal Information” to us, which ‎is ‎‎information that identifies you personally, such as your first and last name, email address, ‎‎‎payment information including financial account numbers, mailing and billing addresses, ‎‎‎government identification numbers, policy number, date of birth, social security number, job ‎‎‎title, marital status, employment information, telephone number, and health, medical, and other information related to your insurance application [3] or claim. Please note that we use a third-party payment ‎‎‎processor and so we do not store information about your payment card when you submit an ‎‎‎online payment. If a claim is reported to us, we may require you to provide ‎‎‎additional information, such as information about your insurance policy, including the policy ‎‎‎number, and information about the harm suffered and the circumstances, causes, reasons, and ‎‎‎events that led to the claim. 

  1. Information About Third Parties.

By submitting Personal Information about any third party, you represent and warrant to Physicians Insurance ‎‎‎that you have the consent of the third party to do so, and that the information you submit is ‎‎‎factually accurate.‎

In addition to any information that you choose to submit to us via our Services, we and our ‎‎third-party service providers may use a variety of technologies that automatically (or passively) ‎‎store or collect certain information whenever you visit or interact with our Services (“Usage ‎‎Information”). Tracking Technologies may set, change, alter, ‎or ‎‎modify settings or configurations on your Device.   • Cookies. A cookie is a data file placed on a Device when it is used to visit our Website. ‎‎‎HTML5 cookies can be programmed through HTML5 local storage.‎

We use third-party analytics services, like Google Analytics, to collect, monitor, and analyze ‎‎‎data we collect through our Services to better understand how our Website is used and to ‎‎‎improve its functionality. Please note that Physicians Insurance cannot guarantee the security of any information you transmit to us. 

  1. USERS OUTSIDE OF THE UNITED STATES

If you are from a non-U.S. country, please be aware that the Personal Information you submit, ‎‎‎including information provided through our Services, is being sent to a location in the United ‎‎‎States. The data protection laws in the United States are likely different from those of the ‎‎‎country in which you are located, and your Personal Information may be subject to access ‎‎‎requests from governments, courts, or law enforcement in the United States according to laws of ‎‎‎the United States.   1. ONLINE BILL PAY 

To submit any online payments to our Services, you must be at least the applicable age of ‎‎majority in your jurisdiction of residence. If you choose to make an online payment, you will be ‎‎taken to our third-party payment processor’s website and you will be prompted to supply ‎‎payment information. By submitting that information to our credit or debit card processor, you hereby ‎‎agree that you authorize us and/or our processor to charge your card at our convenience, but ‎‎within thirty (30) days of credit or debit card authorization. Information about our Personal Information Processing Activities

Personal Information is retained based on internal retention policies, which typically requires retention for a period of seven years. Information is segregated by legal retention requirements and maintained in accordance with various local, state, federal, and other legal requirements. Personal information will not be retained beyond the reasonably foreseen need to retain the information for legal or business purposes.

We do not sell consumers' Personal Information.

We do not share Personal Information (for purposes of cross-context behavioral advertising).

We do not sell or share (for purposes of cross-context behavioral advertising) the personal information of minors under 16 years of age.

We share cookies with third parties as described in our online privacy policy. To opt-out of the sharing of information with third parties in this context, please review our online privacy policy for instructions or adjust your browser settings accordingly.

We do not use or disclose Sensitive Personal Information for purposes other than the following:

  1. To perform the services or provide the goods reasonably expected by an average consumer who requests those goods or services.
  2. To prevent, detect, and investigate security incidents that compromise the availability, authenticity, integrity, or confidentiality of stored or transmitted personal information.
  3. To resist malicious, deceptive, fraudulent, or illegal actions directed at the business and to prosecute those responsible for those actions.

Your Privacy Rights

Submitting Consumer Requests

You may submit a consumer request to us by email at talktous@phyins.com, or by phone at (800) 962-1399 (toll free) to make a consumer request. You may make up to two disclosure requests in any 12 month period.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

Making a verifiable consumer request does not require you to create an account with us.

When you submit a verifiable consumer request, we will take steps to verify your request by email or telephone call. In some cases, we may request additional information in order to verify your request or where necessary to process your request. If we are unable to adequately verify a request, we will notify the requestor. Authorized agents will be required to provide proof of their authorization and we may also require that the relevant consumer directly verify their identity and the authority of the authorized agent.

We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Right to Know and Access Your Information

You have the right to request that we disclose to you certain descriptions and categories of the personal information we collect, use, disclose, share, or sell about you. For example, you may request the following through a consumer request:

  1. The categories of personal information we have collected about you.
  2. The categories of sources from which the personal information is collected.
  3. The business or commercial purpose for collecting, selling, or sharing personal information.
  4. The categories of third parties to whom we disclose the personal information.
  5. The specific pieces of personal information we have collected about you.

Right to Request Deletion

You have the right to request that we delete your personal information. See above for additional details about how to submit a consumer request.

You should be aware, however, that California law allows us to retain your personal information under certain conditions, even if you have asked us to delete it, such as when retaining your personal information is necessary for us to complete a transaction with you or provide you with a good or service you have requested. We will notify you of any denial of your deletion request and the reason for such denial.

Right to Non-Discrimination for Exercise of Consumer Privacy Rights

We will not discriminate against you because you have chosen to exercise any of your privacy rights provided by the CCPA.

Right to Opt-Out of the Sharing or Sale of Personal Information

We may share personal information we collect about you with third parties for purposes of cross-context behavioral advertising. We do not sell personal information we collect about you, as the term "Sale" is defined by the CCPA. You may opt out of the sharing (for purposes of cross-context behavioral advertising) of your personal information by signaling an opt-out preference by making an opt-out request.

To submit a request under the Right to Opt-Out, please provide the information necessary to identify the consumer to whom the request should be applied and reasonable identifying information that you are authorized to make the request and submit an email requesting your "Right to Opt-Out" to talktous@phyins.com, or by phone at (800) 962-1399 (toll free).

Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales. However, you may change your mind and opt back in to personal information sharing or sale at any time by contacting us.

Authorized agents will be required to provide proof of their authorization to submit opt-out requests and we may also require that the relevant consumer directly verify their identity and the authority of the authorized agent in limited circumstances.

Using an Authorized Agent

You may use an authorized agent to submit a consumer request. To use an authorized agent, you will need to (i) provide written instruction to your agent, and verify your identity to us, or (ii) provide a power of attorney pursuant to California Probate Code Sections 4000 to 4465.
